The witness Liana Melkonyan testified that in February 2008 Souren Sirunyan several times called her and told that he was spending days and nights in the Azatutyun Square with his friend Samvel Abovyan. After that from March 3 to March 8 he called from Georgia by a Georgian phone number. After calling for the first time, when she asked Souren Sirunyan of his whereabouts, Souren Sirunyan said that he was in Georgia, then Liana Melkonyan asked, “Are you on the run?”- To which S.Sirunyan answered “yes”. She also asked him- “Have you also been there?”- referring nearby the statue to Myasnikyan in Yerevan, to which Surik answered “yeah”. After that she inquired, “Are you alone or is there anybody with you?”, referring to the persons on the run with him, to which Surik replied that he was not alone, there are other people with him, but did not mention any names. After that Souren Sirunyan called again during the following days and informed that he was still in Georgia and did not know when he would come back.
Witness Melkonyan’s evidence was confirmed also by the record of examination of Souren Sirunyan’s passport concerning the “Visa” section of the passport, where in temporal terms, as the latest records double stamp of “Bagratashen” customs station of the Republic of Armenia and “Sadakhlo” customs station of the Republic of Georgia were applied, in accordance with which the person persenting the aforementioned passports crossed the border of the Republic of Armenia on “02.03.2008” (March 2, 2008) through Bagratashen customs station and entered the Republic of Georgia, and on “09.03.2008” (March 9, 2008) crossed the border of the Republic of Georgia and entered the territory of the Republic of Armenia on the same day.
By the decision as of July 23, 2008 protective measures were applied to the witness within the criminal case in accordance with procedures under Articles 98, 98-1, 98-3 and 99 of the Code of Criminal Procedure of the Republic of Armenia, whose family name, name and patronymic name were replaced with pseudonym “Serob Serobi Serobyan”, which was also used in materials of the criminal case and other documents and media, as well as was used limitation of information about the person under protection in the records of intelligence actions or court sessions.
In a result of the abovementioned search and investigation operations were obtained additional information concerning actions aimed at seizure of power by force by violation of the Constitution of the Republic of Armenia, planning, organization and implementation of mass disorders, people, who implemented those actions, the role of each of them, as well as concerning a number of other facts important for the criminal case.
“Serob Serobyan” gave evidence that his cell mate accused by the Article 300 of the Criminal Code of the Republic of Armenia told him in the conversation that Alexander Arzumanyan, Myasnik Malkhasyan, Hakob Hakobyan, Khachatur Sukiasyan and others were involved in planning and organization of actions aimed at seizure of power by force by violation the Constitution of the Republic of Armenia. Large financial means were used for recruiting people for a certain fee and providing their participation in mass public actions that were taking place in Yerevan in violation of the established order on February 20, 2008. Besides, by means of inflaming terror they urged the crowd to violence and resistance to the representatives of the authorities. Besides, there were separate groups of armed persons, intended for the armed attack.
“Serob Serobyan’s” cell mate also told him that the organizers of the upheaval have decided in advance the posts for each of the leaders of the upheaval following the change of power.
In accordance with “Serob Serobyan’s” testimony the cell mate told him that despite they did not manage to complete the upheaval on March 1, 2008, but they managed to the maximum possible extent weaken the state authorties and make them vulnerable.
In accordance with testimony of more that two hundred aggrieved persons, their successors and represetatives concerning the bodily injuries caused to them by the use of explosives and explosive devices, grenades, bottles filled with flammable luquids, bludgeons, polls, stones, and other items adopted for causing bodily injuries, as well as violence exercised by the participants of mass disorders that were taking place on March 1-2, 2008 on the crossroads of Paronyan and Leo streets and G.Lusavorich and M.Mashtots avenues and the territories adjacent to embassies of France and Russian Federation, “Ardshininvest” bank and Fish shop, as a result of which a number of shops were robbed, cars were burned and property was damaged or destroyed in especially large scale.
Records of mass disorders that took place in Yerevan on March 1-2, 2008 that are considered as evidence and are included in the materials of the criminal case on laser videodiscs, the records of their playback and examination confirmed that on March 1 and March 2, 2008 the participants of mass disorders that took place in the central streets of Yerevan were making barricades with cars, buses, and trolleybuses parked in Grigor Lusavorich Street, Italian Street, Beirut Street, Paronyan Street and Mashtots avenue. Intentionally a number of cars parked in the streets were overturned, broken, damaged and burned, and shops were broken and robbed, armed resistance to the representatives of the authorities (members of the police and servicemen of the forces of the Police of the Republic of Armenia executing protection of public order) was shown, participants of mass disorders were beating them. The participants of mass disorders were periodically throwing stones, iron bars, bludgeons, burning bottles filled with flammable liquid, explosive devices and grenades at the members of the police and servicemen of the forces of the police, as well as were firing at the latters; this episode is shown at 07:21 minute of disk 4.
Video materials also confirm that the abovementioned actions were directly inspired, organized, coordinated and managed by Nikol Pashinyan, Alexander Arzumanyan, Shant Harutyunyan and others.
Episodes depicted in file 015 of disk 1 confirm that with the purpose of planning the subsequent actions of the organizers of mass disorders regularly were taking place consultations between Nikol Pashinyan, Alexander Arzumanyan, Myasnik Malkhasyan, Sasoun Mikaelyan and others.

By deciphering of the telephone conversations of Myasnik Malkhasyan and Souren Sirunyan that were examined and considered as an evidence, was confirmed the fact that during January-March 2008 Myasnik Malkhasyan, Sasoun Mikaelyan, Hakob Hakobyan, Khachatur Sukiasyan, Nikol Pashinyan, Alexander Arzumanyan and Souren Sirunyan were in constant telephone contact with each other.
Based on the testimony of a witness, proxy of Nor Norq criminal department Samvel Hakobyan – on March 1, 2008, in accordance with general command, they implemented more reinforced services nearby the Yerevan City Hall, where mass meetings started. He has known Shant Harutyuinyan since 1999 as he was in charge of Nor Norq 1st Massive, where Shant Harutyunyan lived. The same day during his duty he was near the monument to Myasnikyan and listened to the speakers. After that Shant Harutyunyan as well made a speech, and the witness immediately recognized him. In his speech he appeled the people with calls for disobedience and provocative calls, encouraging them not to leave, stay up until morning to celebrate the victory of their actions.
Shant Harutyunyan requested from people to disobey legitimate demands of the law-enforcement authorities, to manifest intolerance, insult policemen with indecent words, consider current authorities as illegitimate and call them a gang, appealed to the necessity to overthrow current authorities and depose them at any cost. Shant Harutyunyan did not consider the ongoing mass disorders and robberies as a crime, but rather as a way of expression of the people’s exultation.
The witnesses Khachatur Arshakyan and Armen Abrahamyan testified that that living in Nor Nork district they knew the inhabitant of the same district Shant Harutyunyan. On March 1, 2008, from curiosity, they went to the territory adjacent to the Yerevan City Hall, where large number of people has been crowded. In the evening approximately at 21:30 they recognized Shant Harutyunyan among the people, who were addressing with speeches-appeals. In his speeches he addressed the crowd with disobediance and provoking appeals and called them not to leave the meeting and stay there until the morning – to celebrate the victorious outcome of their deeds. Shant Harutyunyan required from people to disobey legitimate demands of the law-enforcement authorities, to manifest intolerance, insult policemen with indecent words, consider current authorities as illegitimate and call them a gang, appealed to the necessity to overthrow current authorities and depose them at any cost.
The witness Tsiala Aghajanyan stated that on March 1, 2008, having watched by TV the events taking place in the capital, leading by curiousity, she went to the territory adjacent to the Yerevan City Hall. Approximately at 21:00, reaching the monument to Miasnikyan, she saw a big crowd of people and a real turmoil. She witnessed the shouting people, the fuss of young people in the state of alcoholic intoxication, disorders. The politicians and representatives of oppositions were addressing the crowded people with provoking speeches and appeals. Their speeches were intended to gather as much people as possible, let nobody leave the place and to wait until the morning’s victorious march. Among the speakers she recognized Shant Harutyunyan, who was in a very aggressive mood and ascending to the scene periodically addressed the crowded people. He demanded from the gathered people not to leave the mass disorder place and, on the contrary, to invite there their relatives, friends and acquaintances, in order to gather as a big crowd as possible. In his speeches Shant Harutyunyan addressed the crowd with appeals and called them not to stay there until the morning – to celebrate the victorious outcome of their deeds.
On March 1, at 21:25 – 00:30 in the evening Shant Harutyunyan periodically addressed the crowd gathered in front of the monument to Miasnikyan and publicly made provoking speeches: “My dear people, I repeat once again: if we fail to win here today, this night, we would not be able to look into our children’s eyes neither today nor ever. And those scoundrels, those officials and their children will spit on the faces of the people like us. We will prove its dignity. But I believe in and I am sure of Armenian people’s will. And today we are so inspired – let our people show its will. And when they make sure that Armenian people didn’t leave the place and celebrated a victory, they will fly away from Armenia on the planes until the morning comes. But we would bring them back and arrest. And I think that once there will be a people’s verdict. And we will convict them in a public court and their punishment will also be public – here or in the Azatutian square.”, made public appeals calling to civil disobedience

Telephone conversation with this context testifies that the members of the group were informed 5 hours beforehand that police subdivisions were planning to run operative measure at Azatutyun Square. They prepared the crowd to resist in advance.
On February 21, 2008 during the mass meeting organized in the Azatutyun Square through violation of law, due to the record of Alexander Arzumanyan speech, he misrepresented the results of the elections as well as perverted the opinion of international observers and word for word announced the following. “Dear friends, I want to state in two words that “Haylur” with its imposture is trying to spread an impression that international community welcomed and adopted those results and evaluate them to be in correspondence with the international standards. It is a pure nonsense. So, according to the preliminary evaluations of OSCE observers the serious criticism and suspicion were expressed on 15% registered results. We continue our work with the observers and to present them all the data, and we are sure that in the final statements these incidents will find their places and the evaluation would be stricter. Moreover we continuously receive supporting telegrams from democratic movements of different counties that convey their assistance to us. It is both representatives of CIS democratic fronts and movements that are our relatives, and the representatives of international community. So, I propose not to be upset on the telegrams that are the results of some embassies activities which provide wrong information to the heads of different countries. It is just usual protocol. It does not have any sense. We have won and we will prove our victory and the whole world shall be adapted to that fact. And today the announcement of the U.S. Department of Justice clarifies that they are worried on the fact of election fraud in 15% of headquarters and before giving the concrete evaluation they well deeply examine all the election fraud facts. Moreover, as was said by Nikol, I appreciate peaceful attitude of thousands participants of the mass meetings and urge the authorities to demonstrate peaceful attitude. Thank you.”
The witness Aristakes Vardanyan testified that on February 21 2008 he went to the pre-election Headquarter of Levon Ter-Petrosyan in Abovyan town, to meet Khachik Martirosyan, since he asked Aristakes to visit him or Grigor Voskerchyan after discharge from the hospital. In front the headquarter he saw a number of residence of his region, he met there with Grigor Voskerchyan and Khachik Martirosyan. The latest informed him that if he would like to earn money he had to transfer the residents of the region every day from the headquarter to the Azatutyun Square in Yerevan city and to bring them back to Abovian approximately at 21.00 o’clock. Khachik Martirosyan gave him 5.000 AMD to charge the bus with the gas promising to pay the rest of money later. All that time Grigor Voskerchyan was next to Khachik Martirosyan. When the people were about to take a bus Grigor Voskerchyan applied to them announcing that the authorities forged the presidential election results, violated the will of the inhabitants, that the people should come together for the victory which must be reached whatever the means were, and to be ready for any actions to strike down the state power and those who would achieve greater resultes in their actions would be financially reimbursed. Being inspired by the mentioned announcements with callings “Struggle up to the end” and “Levon –the President” they took the buses and moved to Yerevan. On the next days in the same way he recruited people and transfered them to Yerevan and back. During the transportation of strikers he knew from the passengers that in the pre-election headquarter the people receive the money for food and cigarettes.
The witness Khamo Namadyan testified that he used to transfer passengers by his personal car “KVZ” model with state number 42 LT 976. In pre-electron period in February 2008 several times by the request of Khachik Martirosyan Khamo transferred people from Levon Ter-Petrosyan’s pre-election headquarter in Abovyan to Yerevan city and back. Last time he transferred people to Yerevan due to Khachik’s request on February 20, 2008. On that day, when the people were about to take a bus, the ex-mayor of Abovyan city Grigor Voskerchyan applied to them announcing that the authorities forged the presidential election results, that in reallity Levon Ter-Petrosyan had won, that everything should be done to bring Levon Ter-Petrosyan to the power, and that the people should refuse the current authorities, to get rid of the Kharabakh’s peoples by whatever means and cost it was, that the people should come together to strike down the state power, and those who would achieve greater resultes in their actions against the state power would be financially reimbursed, as well as will receive a job opportunity prom Levon Ter-Petrosyan. He transferred the strikers to Yerevan and went back. Hearing Grigor Voskerchyan’s speech he did not provide his bus for the same reason anymore. Grigor Voskerchyan paid to him 10.000 drams for the provided service.

The accusations brought against the accused Alexandr Arzoumanyan, Myasnik Malkhasyan, Sasoun Mikayelyan, Hakob Hakobyan, Shant Haroutyunyan, Grigor Voskerchyan, Souren Sirunyan were grounded by the following evidences, obtained during the criminal case.
The witness Garnik Aleksanyan testified that from February 20, 2008 he took part in mass meetings in the Azatutyun Square of Yerevan city. In tents with inscriptions “Hrazdan”, “Kochor”, “Meghradzor”, the residents of Hrazdan region, familiar and unfamiliar to him, spent nights. They were ruled and financed by the MP Sasoun Mikaelyan. The latter via the head of regional department of the ANM (Armenian National Movement) Aram Bareghamyan, paid 5000 drams to the countrymen, which came to the Azatutyun Square for spending the night. In the mentioned tents he saw hidden iron bars, alcoholic beverages, outside – petrol bottled in blue containers and other highly inflammable materials.
The witness Garik Manasyan testified that on February 23 or 24 he took part in a mass meeting on the Azatutyun Square of Yerevan city, which lasted for 5-8 hours. There he met the residents of Hrazdan region, which took part in mass meetings. Late at night among them he noticed the MP Sasoun Mikaelyan. He approached and took part in the conversation. Sasoun Mikaelyan persuaded his fellow-countrymen, saying that nothing was left, that soon they would win; they all would be shown the place they were from, he required to be ready to stand for the victory. Inspired by his words, the gathered people shouted they were ready to obey the command of the “commandir” (the Russian pronunciation of the word “commander”) and even to die, as soon as the command was given.
The witness Arsen Mkrtchyan testified that on February 25 2008 he went to Yerevan to take part in mass meeting organized on the Azatutyun Square. There he met his companion-in-arms, member of the RA NA Sasoun Mikayelyan. He came to him and asked what will happen at the end. Sasoun Mikayelyan answered that the change of power will happen, at any price.
Inspired by the words of Sasoun Mikayelyan with residents of Hrazdan, gathered near the tents with inscriptions “Hrazdan”, “Kochar”, “Meghradzor”, ruled by Sasoun Mikayelyan, he took part in mass meetings. Becoming aware that the RA CEC announced the election results and that Serzh Sargsyan was elected as the RA President, he appealed to Sasoun Mikayelyan, suggesting him to quit the struggle. Sasoun Mikayelyan answered that they will struggle up to the end and they will go to the change of power, whatever the cost is. Then he called to be ready to everything. Inspired by the words of Sasoun Mikayelyan he stayed in the Azatutyun Square. From 27 to 28 of February, 2008, late at night, from blue with white stripes car “RAF” together with the men from the same village he transported different types of pipes and woods and hid them in tents with purpose to use against the police. On March 1, 2008 he was waken up by the noise and noticed that rioters were fighting with police officers, using woods, stones and iron. Without taking part in the clash, he left the square, and then with other people he moved to the The Embassy of Francein Armenia. For a while staying there, realizing that a war situation was beginning, he went back to Hrazdan.
The witness Shavarsh Manukyan testified that after February 20, 2008, several times, by the offer of Grigor Voskerchyan, he took part in mass meetings, held on the Azatutyun Square, where Grigor Voskerchyan gathered residents of the region and said that it is important and preferable to stay on the Azatutyun Square. Grigor Voskerchyan promised to provide them with food and money. In the morning the crash between the police and participants of mass meetings began, after which the participants of mass meetings gathered near the Embassy of France.

It is obvious from the telephone conversations that Alexandr Arzumanyan has an active role in the organization mass disorders and that at the peak of mass disorderss, in the conditions of armed clashes he and his supporters were mostly concerned of keeping the participants in that area, which they didn’t succeed to do, because of the reason not depending on them – a state of emergency was declared.

It is clear from the conversation that the organizers are concentrating the people in the The Embassy of Franceneighborhood according to a closely developed plan. Moreover, Alexandr Arzumanyan should have known where different forces were centered in various parts of the townand what they were doing.

By the law interception of Alexandr Arzoumanyan’s phone conversations, recognized as proofs, during which in a situation of skirmish and armed resistance against the representatives of authorities, he encouraged the gathered people, including participants of mass disorders, and announced word for word the following: “Dear people, the whole world is proud of you, we will stay up to the end, the victory is upcoming, remains one or two days, victory”.
Examined and recognized as proof materials of Alexandr Arzoumanyan’s telephone conversations’ law interceptions, state his organizational role as in mass meetings and demonstrations, so in the mass disorders, which took place in Yerevan City on March 1-2, 2008.
